Relay — Terms of Service

These Terms govern your use of Relay, a product of Inside Charleston LLC ("Relay," "we," "us"), a South Carolina limited liability company based in Mount Pleasant, South Carolina, and the owner and operator of getrelaykit.com. By creating an account, purchasing a plan, or using the service, you agree to these Terms. If you do not agree, do not use Relay.
1. What Relay is, and what it is not.
Relay provides done-for-you websites, local web pages, lead capture, an AI chat assistant, an optional AI voice receptionist, follow-up automations, a lead inbox, and related tools for trade businesses. The AI assistant and voice receptionist exist to greet, answer questions, capture lead details, and relay them to you. Relay does not book appointments, confirm times, provide quotes or pricing, dispatch technicians, or perform your trade work. Relay is a software tool, not a contractor, marketing agency, legal advisor, or licensing authority, and nothing it produces is professional, legal, or trade advice. In any emergency, users should call 911 or the appropriate emergency line.
2. No guarantee of results.
We do not guarantee any specific number of leads, calls, customers, search rankings, traffic, or revenue. Local search performance depends on factors outside our control, including third-party platforms like Google. You use Relay at your own business risk.
3. Your responsibilities and your content.
You are responsible for the accuracy of everything you provide, including your business details, license number and type, insurance status, service areas, services, photos, project entries, and any reviews you add. License and trust details you enter are self-reported by you and are not independently verified by Relay; you are solely responsible for holding all licenses, insurance, bonds, and permits required for your work, and for confirming them with the relevant authority. You will not add fabricated, fake, or misattributed reviews or content, and you will comply with all laws applicable to your business. You retain ownership of the content you provide and grant us a non-exclusive license to host, display, and process it to operate the service.
4. Communications, AI, and recording.
By providing a phone number or messaging Relay or a Relay-built site, you and your customers consent to receive calls, texts, and emails related to the service, and you may opt out at any time by replying STOP or contacting us. AI systems can make mistakes and may not always be accurate; you are responsible for reviewing leads and for your own communications with your customers, including obtaining any consent the law requires in their location. If call recording is enabled, you are responsible for any multi-state consent requirements; recorded calls play a notice when recording is on.
5. Data roles.
For personal information submitted by your customers and site visitors, you act as the controller and Relay acts as your processor and service provider, handling that information on your behalf to deliver the service. You are responsible for having a lawful basis to collect it and for your own privacy obligations to your customers.
6. Fees, billing, and cancellation.
The Launch Package is a one-time fee, and plans are billed monthly or annually in advance through our payment processor, Stripe. You authorize recurring charges until you cancel. Fees are exclusive of taxes. Setup and work performed are non-refundable once started. You may cancel a recurring plan at any time, effective at the end of the current billing period; we do not provide prorated refunds for partial periods unless required by law.
7. Intellectual property.
Relay, including the platform, templates, software, designs, and the Emma mascot, is owned by Inside Charleston LLC and is licensed to you, not sold. You may not copy, resell, reverse engineer, or create competing products from it. Your business content remains yours.
8. Disclaimers.
The service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the fullest extent permitted by law.
9. Limitation of liability.
To the fullest extent permitted by law, Inside Charleston LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost leads, lost data, or lost business. Our total liability for any claim arising from the service will not exceed the amount you paid us in the three months before the event giving rise to the claim.
10. Indemnification.
You will defend, indemnify, and hold harmless Inside Charleston LLC and its members from any claims, damages, or costs arising from your content, your trade services and work, your licensing or insurance, your communications with your customers, or your violation of these Terms or the law.
11. Termination.
We may suspend or terminate access for violation of these Terms, non-payment, or misuse. You may stop using the service at any time. Sections that by their nature should survive termination will survive.
12. Governing law.
These Terms are governed by the laws of the State of South Carolina, without regard to conflict-of-law rules. The exclusive venue for disputes is the state or federal courts located in Charleston County, South Carolina, and you consent to that jurisdiction.
13. Changes.
We may update these Terms. Material changes will be posted here with a new "last updated" date, and continued use after changes means you accept them.
14. SMS Program.
Relay offers text-message notifications as part of the service. The program name is Relay Customer Care Notifications. Message and data rates may apply. Message frequency varies. For help, text HELP. To cancel, text STOP. For support, contact concierge@insidecharleston.com.
